1. ELIGIBILITY AND PARTICIPATION.
a) This contest is hosted by Doteasy Technology Inc. (www.doteasy.com).
b) This contest is open to anyone except employees of Doteasy Technology Inc., its contest sponsor, advertising and promotional agencies and their respective affiliates and associates and such employees' family members.
c) Contestants are responsible for compliance with applicable laws in jurisdictions where they reside.
d) By entering this contest, entrants automatically agree to be bound by the terms of this contest as listed in this Contest Terms and Conditions, as well as the Doteasy Service Terms and Conditions, and the Doteasy Hosted Blog User Agreement.
e) Failure to adhere to the terms and conditions listed in this Contest Terms and Conditions, and/or those listed in the Doteasy Service Terms and Conditions, and the Doteasy Hosted Blog User Agreement will result in disqualification of any submitted entries, and the nullification of contestant privileges to further participate in the contest.
2. SUBMISSIONS OF ENTRIES AND DEADLINES.
a) The Contest will be open for entry submissions starting February 1, 2008. All entries must submitted no later than 11pm PST, Sunday, March 2, 2008. Late entries will be rejected.
b) To be eligible to participate, entrants must submit their entries via the Contest Entry Form. In completing the entry form, entrants must provide their name, valid email address, a link to their blog and all other required information.
c) Incomplete entry forms will be deemed disqualified and will be rejected. Doteasy Technology Inc. is not responsible for any lost, misdirected or delayed entries. There is also no responsibility or liability for any potential entrant's inability to access the official Contest Entry Form for contest entry. Entries received by telephone, fax, courier, personal delivery or Customer Service Ticket or any other method other than the official Contest Entry Form will not be accepted.
d) Contestants must allow Doteasy a 3 business day window, upon the submission of the contest entry, to take necessary screenshots, and/or gather all necessary information of the entry for the voting process. If insufficient time is allowed and Doteasy is unable to obtain necessary screenshots of the entry, the entry will be deemed "incomplete" and will be disqualified. Doteasy may, at its sole discretion, contact the entrant to resubmit the entry for the contest.
e) Each submission must be the property of the entrant, or entrant must have proof of permission from the owner/author of the property to distribute the content.
f) Each contestant may submit up to three (3) designs, but only one prize per contestant will be awarded.
g) By submitting any entry, entrants agree to be bound by the terms and conditions set forth in this document, including, without limitation, the Doteasy Service Terms and Conditions, and the Doteasy Hosted Blog User Agreement. Entries must not include content that are unlawful, harmful, vulgar, obscene, hateful, or racially, ethnically or otherwise objectionable, the determination of which is up to the sole discretion of Doteasy.
3. WINNER SELECTION AND NOTIFICATION.
a) Judging. All eligible entries will be reviewed by a panel of judges selected by Doteasy. Members of the judging panel will consist of Doteasy staff from various departments in Doteasy. The judges shall have the sole discretion to select the eight (8) entries to be submitted to the weekly polls on the Doteasy Blog. Entries will be selected based on such criteria as they determine to be appropriate, including but not limited to: i) completeness of design, ii) editorial judgment in design, iii) effective use of color and/or typography, iv) quality of images, v) uniqueness/originality of design, vi) appropriateness of elements, and vii) overall appearance of blog.
b) Weekly Polls. There will be three (3) rounds of weekly polls. The weekly polls will be publicly accessible on the Doteasy Blog. The polls will remain open for one (1) week to Doteasy Blog readers and members of the general public. Voters will be asked to select their favorite blog based on such criteria, including but not limited to: i) completeness of design, ii) editorial judgment in design, iii) effective use of color and/or typography, iv) quality of images, v) uniqueness/originality of design, vi) appropriateness of elements, and vii) overall appearance of blog. The two with the most votes in each weekly poll will have a guaranteed spot in the Final Voting, where eight (8) finalists will compete for the grand prize. The eight (8) finalists will consist of the 6 top two weekly poll designs and two (2) additional designs chosen by Doteasy staff.
c) Dates of Voting. The first weekly vote will begin on February 7, 2008, and will close at 5pm PST on February 13, 2008. The second weekly vote will begin on February 14, 2008 and will close at 5pm PST on February 20, 2008. The third weekly vote will begin on February 21, 2008 and and will close at 5pm PST on February 27, 2008. The Final Voting will begin on March 6, 2008 and and will close at 5pm PST on March 16, 2008. These dates are subject to change depending upon the number of qualified entries and contest participants.
d) Notification of Winners. Winners of prizes shall be notified immediately following the announcement of the winners on the Doteasy Blog on March 19, 2008. As a condition to receipt of their prize, prize winners maybe required to signed and return the Contest Prize Release Form within 72 hours of notification.
4. PRIZES
a) First prize. The Contest first-place winner will win a new ASUS Eee PC 2G Surf Notebook, in their choice of color (Sky Blue, Lush Green or Blush Pink).
b) Second prize. The Contest second-place winner will win a new Canon PowerShot A560 7.1MP Digital Camera.
c) Third prize. The Contest third-place winner will win a new RJ Tech 7IN LCD Digital Photo Frame.
d) Odds of winning a prize will vary depending upon the number of actual Contest participants. In the event any entry is deemed ineligible or disqualified, Doteasy may award the prizes to alternate entries as it deems suitable. In any event that the prize cannot be awarded, Doteasy may withdraw the winner's title, and all unclaimed prize(s) will be forfeited and Doteasy may select an alternate winner.
e) In accepting the prizes, the contest winners acknowledge that Doteasy Technology Inc. may not be held liable for any loss, damages or injury associated with accepting or using the prize(s).
5. CONTEST SUBMISSION AGREEMENT.
a) Original Works. All entries must be the original creations of the entrants, unless written authorization from the intellectual property owner is provided at the time of entry submission. Contestants agree to indemnify and hold harmless Doteasy and it's contest sponsors from any copyright, trademark, or other intellectual property infringement claim or liability with regard to their submissions.
b) Submitted Entries. By submitting any design entry for the Contest, the contest grants Doteasy Technology Inc. and Doteasy.com a non-exclusive, worldwide, royalty-free right for the duration of the contest to display a screenshot of the submitted entry in association with this contest on its websites, for commercial, business, and trade purposes, as well as for advertising and/or publicity purposes. Additionally, contestants hereby agree and acknowledge that Doteasy may, in its sole discretion, display the screenshot of submitted entries, in whole or in part, distorted in character or form, on, but not limited to, the websites www.doteasy.com and the Doteasy Blog (doteasyblog.com, blog.doteasy.com and apps.doteasyblog.com/blog).
c) Submitted Content. Contestants may NOT submit offensive, pornographic, obscene, criminal or adult themes, links or images. In addition to this Contest Terms and Conditions, all submitted content must abide to the Doteasy Service Terms and Conditions, and the Doteasy Hosted Blog User Agreement. Doteasy reserve the rights to decide what constitutes deletion, suspension, or banning within the contest.
6. GENERAL
a) Releases. All entrants, as a condition of entry into the Contest, agree to release Doteasy Technology Inc., staff and its Contest sponsors from and against any and all liability, claims or actions of any kind whatsoever for injuries, damages, or losses to persons or property associated or sustained in connection with participation in any and all aspects of the Contest, including accessing the Contest, submitting an entry, the receipt, ownership or use of any prize. Each prize winner bears all risk of loss or damage to his or her applicable prize after it has been delivered.
b) Prize Responsibility. All prize winners will be responsible for any and all federal, state and/or local taxes resulting from acceptance of any and all prizes associated with this Contest. Prize winner cannot assign or transfer the prize to another person. No prize substitution or changes are allowed. All prizes are subject to availability. If a prize cannot be awarded due to circumstances beyond the control of Doteasy, a substitute prize of equal or greater retail value may be awarded.
c) Limitation of Liability. Neither Doteasy Technology Inc., its staff, nor its Contest sponsors assume any responsibility or liability for (i) any incorrect or inaccurate entry form information, or for any faulty or failed electronic data transmissions; (ii) any authorized access to, or theft, destruction or alteration of entry forms or submissions at any point in the operation of this Contest; (iii) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilized in any aspect of the submission of an entry or the operation of the Contest; (iv) inaccessibility or unavailability of the Internet; or (v) any injury or loss of participants which may be related to or resulting from any attempt to participate in the Contest or download of any materials in the Contest.
d) Disputes. You agree that you will submit any dispute you may have with regard the conduct of the Contest, interpretation of the Rules, and/or awarding of prizes to Doteasy, whose decision regarding such dispute shall be binding and final. All disputes must be submitted in writing, and sent to us at: Doteasy Technology Inc., Suite 210 - 3602 Gilmore Way, Burnaby, BC, Canada V5G 4W9.
e) Winners. All voted decisions are final.
f) Winner Announcement. A list of prize winners will be available on the Doteasy Blog on March 19, 2008. All prize winners will be further contacted by Doteasy.com via email for the claiming of their prizes.
g) Age of Participation. Any participant under the age of 16 is required to notify Doteasy before entering in to any competition processes. Participants under the age of 16 may be required to provide proof of parental consent, either in writing by postal mail or facsimile transmittal, at any time during the competition process. If a winner of any award is under the age of 16, parental consent in writing by postal mail or facsimile transmittal will be required.
h) Terms. Doteasy Technology Inc. reserves the right to abbreviate, modify, suspend, cancel, or terminate this Contest at any time without prior notice, and without further obligation or liability to you. Doteasy Technology Inc. also reserves the right to change this Terms and conditions at any time without prior notice.
